Most Lawless Administration

The basic principle of the American experiment was to provide a Government of the people, by the people and for the people.  The government will not function efficiently, and perhaps not survive, if the PEOPLE do not maintain a constant vigilance and develop - what Thomas Jefferson called an intelligent and informed electorate.

Thomas Jefferson in the Declaration of Independence writes that 'all men are endowed by their ...Creator with certain unalienable rights , .. and to secure these rights, governments are instituted.  When a Government protects the rights of its people and provides an adequate remedy for those whose rights have been violated, then that Government is providing equal justice for all.  The Constitution is designed to provide equal justice for all.

It is my opinion that we are currently served by the most irresponsible and lawless administration, flagrantly ignoring, bypassing or discounting the Constitution  Yet in both inaugurations, the President swore to faithfully "execute the office of President of the United States and to the best of his ability, preserve, protect and defend the Constitution of the United States."  As a continuum of such egregious action, the following events which revoke that Presidential affirmation have been perpetrated on Sovereign States and 'We the People" throughout the United States:

·        The Federal Communications Commission (FCC) regulated the Internet despite a court order from the Washington DC Circuit Court of Appeals asserting FCC had no power to perform such regulation;

·        The Environmental Protection Agency (EPA) imposed cross-state Air Pollution regulations on Texas without an opportunity for the State to response; the basis of the regulations represented EPA over-reach on an unproven claim Texas air pollution impacted the only air-quality monitor located in Granite City, Illinois, some 500 miles north;

·        The Department of Justice rejected voting rights acts by States that had been approved by the Supreme Court, ignoring Section 8 of the Voter Rights Act requiring protection against voter fraud, using Section 5 of the Voter Rights Act to block protective measures enacted by legal action within the State Legislatures;

·        The Department of Justice, violating the 10th Amendment to the Constitution, sued to prevent Arizona from utilizing reasonable measures controlling illegal immigration within the State, a major public problem for the State of Arizona;

·        The White House made 'recess appointments' to the National Labor Relations Board (NLRB) and Consumer Financial Protection Agency when Congress was NOT IN RECESS, ignoring the ruling of the Circuit Court of Appeals, Washington DC.

·        The Equal Opportunity Commission (EEOC) interfered with church self-selection of ministers in Michigan by trying to force reinstatement of a minister discharged for religion doctrinal disagreement;

·        The Department of the Interior (DOI) forced gambling into the Arizona town of Glendale, a family-oriented town, by granting 'reservation status' to a 54 acre plot where the Tohon O'odham Indian Nation is planning a resort/casino;

·        More than 300,000 illegal aliens, captured by INS, processed and awaiting deportation were stopped with Obama ordering US Border Patrol to release illegal's with no explanation or documentation;

·        Over a period of 24 hours, the Obama Administration issued 21 Executive Orders that attack/undermine Second Amendment right to keep and bear arms, among them an amendment to the Affordable Care Act to allow doctors and hospitals to investigate which patients own guns;

·        The Health and Human Services Department has, own its own, issued mandates that all Government Health Plans include coverage for abortion-inducing drugs, in some cases, including coverage for abortion in breach of the 1993 Freedom Restoration Act, First Amendment, and Affordable Care Act prohibition use of taxpayer funds for such payments;

·        Department of Justice termination of the 2008 conviction of the New Black Panthers for brandishing weapons at polling places and threatening voters in Philadelphia and with videotaped threats to passerby voters to 'kill some crackers' and 'kill white babies';

·        Without Congressional Approval, the Administration devastated the work requirements for welfare recipients passed by Congress/signed into law by President Clinton;

·        Authorized, in the GMC and Chrysler bail-out, to shortchange bond holders in favor of Labor Unions in the face of bankruptcy law specifying bond holders be first to be repaid;

·        The Administration forced defense contractors to NOT ISSUE layoff notices in October 2012 in violation of the WARN Act requiring such notification;

·        The President and his Administration lied to Congress and citizens regarding the death of Ambassador Chris Stevens and three Americans by stating an 'anti-Islamic video' was the cause of the spontaneous uprising in Libya while fully knowing that the attack on 11 September 2013 was a well-planned al Qaeda military assault;

·        The National Labor Relations Board (NLRB) unconfirmed general counsel threatened to bring suit against South Carolina's guarantee of secret ballot in union elections, ignoring 83% of the State's citizens vote for the amendment as a ballot item with follow-on intimidation tactics applied to Boeing to force the company to construct its plant where the NLRB wanted it, specifically not in South Carolina.

·        The Administration used the Internal Revenue Service (IRS) to target Christian, Conservative, Israeli Supporters, individuals, e.g. Wayne Root-author of The Obamacare Survival Guide, Reverend Franklin Graham, etc., 500 organizations with Tea Party or Christian in their name, in the form of excessive audits or withholding of 501(c)3 Status by imposing requirements on group Facebook name lists, donor and intern name lists, book reading lists and Facebook posts;

·        In Florida, the Environmental Protection Agency imposed its costly, unprecedented and unscientific numeric nutrient criteria on the State's aggressive and innovative water quality protection program; Florida estimated the cost of compliance to be astronomical and challenged with the federal justice rejection of the EPA program based on unsound science and failure to prove any benefit to the environment.

Whether it is through the Environmental Protection Agency, Department of Justice, National labor Relations Board, Surface Mining Office, Federal Communications Commission and other Administrative departments, The Obama Administration has aggressively used agencies it controls to implement policy objectives that can not gain congressional approval and lie outside the laws of this nation; it is fulminating tyranny of the highest order.  Should it stand or should we comply and perish?
